TOPIC: Permitting Strategy: Project Aggregation

Timing is everything, unless you are dealing with project aggregation.  In 2009, EPA issued a final rule defining when multiple projects at a site should be considered part of the same project for NSR applicability.  The rule was immediately stayed indefinitely.  Ten years later, in November 2018, EPA lifted the stay, thus re-instating the 2009 rule.  The rule, though now effective, is currently being challenged in court.   Prior to the 2009 rule, the timing of projects was an important tool that was commonly used in project aggregation.  Under the 2009 rule, technical and economic dependency are first used to determine if projects are “substantially related” before considering the timing of the projects.  The details of the project aggregation rules and examples will be discussed.
